Each of the automotive manufacturing companies that market lubricants have tech service reps and/or sales personnel who are charged with the responsibility of selling dealers and/or consumers. Since lubricants are a sideline to these companies, the sales reps are not generally as well versed in petroleum product sales as oil company salesman. They do however, have a lot of influence on the potential customer because they represent the manufacturer.

There is a federal law known as the Magnusson-Moss Warranty Improvement Act. One provision of this statute prohibits a manufacturer from requiring consumers to use private label service or products as a condition of warranty, either written or implied, unless such manufacturer gives the product away free, or has a specific legal waiver from the Federal Trade Commision. We are not aware of such waivers on any type of petroleum product.

Competitiveness, and the sucesses by these organizations to take away business, has reached a point where your help is needed locally to combat such unfair trade practices.

Frequently, customers, friends or employees will advise you that a representative of some manufacturer has tied in a brand of lubricant to their warranty. When such an opportunity arises, ask them to request such statement in writting or that the representative supply the lubricant free of charge. Refusal to do so may indicate a violation of federal law.
